REASONS FOR DECISION

These two applications which were joined at the outset of the hearing, were made by the Australian Liquor, Hospitality and Miscellaneous Workers Union (Tasmanian Branch) (the Union) and sought to vary the Licensed Clubs Award and the Hotels, Resorts, Hospitality and Motels Award (the two awards) by increasing the meal or tea money allowances prescribed in the two awards.

The Union submitted that the increase sought reflected the relevant movements in the Consumer Price Index (CPI) of the Australian Bureau of Statistics from the June quarter 1995 till the June quarter 1996. The Union submitted that the applications were in accord also with the decisions of the Commission in matters T5763 of 1995 and T6582 of 1996 which were Full Bench decisions granting meal or tea money allowance increases in quite a number of the awards of the Commission.

These two applications sought an increase of 20 cents taking the meal or tea money allowance prescribed in the two awards from $9.25 to $9.45. This was the same as the meal allowance increase granted in matter T6582 of 1996.

The Union requested that the increases be made to take effect from the first full pay period to commence on or after 5 June 1997.

The Tasmanian Chamber of Commerce and Industry (the Chamber) advised its consent to the applications and confirmed that the increases claimed:

· satisfied the Wage Fixing Principles of the Commission, in particular those relating to expense related allowances;

· were in accord with the relevant CPI movements and the previous decisions of the Commission in relation to such increases; and

· were within the public interest requirements of the Industrial Relations Act 1984.

The Chamber also advised its consent to the date of operation claimed by Union.

The Registered Clubs of Tasmania Co-operative Society Limited, in relation to the Licensed Clubs Award, also indicated consent to the application.

I accept the submissions of the parties; the two awards will be varied where appropriate by increasing the meal or tea money allowance from $9.25 to $9.45 to take effect from the first full pay period to commence on or after 5 June 1997.
