REASONS FOR DECISION

In these matters the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch (the Union) applies to vary the Veterinary Services Award to include the second and third $8 Safety Net Adjustments. The Tasmanian Chamber of Commerce and Industry Limited (TCCI) supports the proposed variations.

In detail, the parties agree to vary the award by consent for the purpose of increasing adult wage rates, as prescribed in Clause 8, in the following manner:

  • by $8 per week (the second $8 Safety Net Adjustment) from the first full pay period commencing on or after 19 March 1998; and
  • by $8 per week (the third $8 Safety Net Adjustment) from the first full pay period commencing on or after 19 September 1998.

The parties submitted that the proposed variations comply with the Wage Fixing Principles and do not conflict with Section 36 of the Act.

I note, for purposes of the record, that Ms P Shelly, appearing for the Union, said by way of explanation:

"... I do want to stress that it is a matter by agreement due to the particular circumstances of this application and in no way is to be regarded as any precedent insofar as the spacing of arbitrated safety net adjustments is concerned with any future applications."

In reply, Mr S Gates, appearing for TCCI, observed:

"Just in relation to other awards: other awards will obviously stand on the facts which pertain to those and will obviously be dealt with in accordance with the Wage Fixation Principles."

Having heard the parties I am satisfied that the applications are consistent with the current Wage Fixing Principles, particularly Principle 7, and do not offend the more general public interest principles of Section 36 of the Act. Accordingly, I will vary the award to reflect the parties' consent applications. My order, which accompanies these Reasons for Decision, will take effect as follows:

  • as to the second $8 Safety Net Adjustment, from the first full pay period to commence on or after 19 March 1998; and
  • as to the third $8 Safety Net Adjustment, from the first full pay period to commence on or after 19 September 1998.
