Award variation - insertion new minimum wage clause as per State Wage Case July 2002 - amendment annual leave clause - consent matter - application granted - award varied - operative ffpp 19 August 2002

REASONS FOR DECISION

(1) This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch lodged on 2 August 2002.

[2] The application sought to vary the Restaurant Keepers Award; and, in particular by:

  • deleting from Clause 9 - Annual Leave, subclause (f)(i) the words "amount equivalent to the minimum wage as prescribed in Clause 8 - Wage Rates, subclause 2 - Minimum Wage." and insert in lieu thereof the words "additional loading of 17.5 per cent."; and

  • deleting from Clause 8 - Wage Rates, the existing subclause 2. Minimum Wage and inserting in lieu thereof a new subclause 2. Minimum Wage arising out of Principle 7 of the State Wage Case decision;

[3] The parties at the hearing presented consent submissions in support of the application and requested the award be varied with a common operative date of the first full pay period to commence on or after 19 August 2002.

[4] This application is approved, as it is consistent with the Wage Fixing Principles.

[5] The Order giving effect to this decision will be contained in the Order arising out of the State Wage Case decision (T10230 of 2002, T10288 of 2002 and T10289 of 2002).
