REASONS FOR DECISION

[1] This application was made pursuant to s.23 of the Industrial Relations Act 1984, by The Association of Professional Engineers, Scientists and Managers, Australia (the applicant), on 10 September 2002.

[2] The application sought to vary the Retail Pharmacy Award and, in particular Part III - Wages and Related Matters, Clause 7 - Occupational Superannuation by inserting new sub clauses (f) (g) and (h).

[3] Mr D Pyrke, for the applicant submitted the new sub clauses:

  • made provision to enable employees to make additional contributions to their superannuation fund;

  • dealt with the frequency of payments of contributions to the fund; and

  • provides for employees to obtain a statement, from the employer, of the contributions paid into the fund for the previous financial year on their behalf, by the employer.

[4] Ms J Thomas, for the Tasmanian Chamber of Commerce and Industry Limited and The Pharmacy Guild of Australia, Tasmanian Branch, did not appose the application and supported the submissions of Mr Pyrke.

[5] The parties also supported the award being varied from the first full pay period to commence on or after 8 October 2002.

[6] This application is approved, as it is consistent with the Wage Fixing Principles.

[7] The Order giving effect to this decision attached.
