REASONS FOR DECISION

(1) This amended application, made pursuant to s.23 of the Industrial Relations Act 1984, by the Tasmanian Trades and Labor Council (the applicant), sought to vary the Group Training Industry Award by amending Clause 2 - Scope and Clause 3 - Definitions, and inserting new clauses relating to wages and conditions, and union representation.

[2] In a decision arising out of application T6173 of 1996 the Commission, as currently constituted, determined that a new award should be established to regulate the employment of employees in the group training industry.

[3] This current application was made to finalise the making of that award.

[4] Ms L Fitzgerald, for the applicant, was granted leave to amend her application to that set out in Exhibit TTLC.1.

[5] Both Ms L Fitzgerald and Ms J Thomas for the Tasmanian Chamber of Commerce and Industry Limited supported the approval of the application.

[6] The parties also supported the award being varied on and from the first full pay period to commence on or after 28 October 2002.

[7] Having considered the submissions of the parties I approve this application as it is consistent with the public interest test as outlined in s.36 of the Act and the Wage Fixing Principles and in particular, Principle 11 - First Award and Extension to Existing Award.

[8] The Order giving effect to this decision attached.
