Industrial dispute - alleged unfair termination of employment - consent order

ORDER BY CONSENT

[1] On 4 November 2002, Joanna Kent (the applicant) applied to the President, pursuant to Section 29(1A) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with Classic Video Pty Ltd arising out of the alleged unfair termination of her employment.

[2] The matter was set down for hearing (conciliation conference) at the Supreme Court, Cameron Street, Launceston at 10.30am Wednesday 4 December 2002.

[3] Mr S McElwaine, sought and was granted leave to appear for the applicant. Mr T Ewing appeared for the employer.

[4] Following preliminary submissions the hearing was adjourned into private conference, with the Commission.

[5] At the conclusion of the conference, the parties requested a consent order be issued in the following terms:

ORDER BY CONSENT

Pursuant to s.31 of the Industrial Relations Act 1984, with the consent of the parties, I hereby order that Classic Video Pty Ltd reinstate Joanna Kent effective from the date of termination less the period of 1 week's notice. Classic Video Pty Ltd to contact Joanna Kent with the view of finalising the details of how the reinstatement will in practice take place.
