Award variation - 9% superannuation - applications approved - operative date ffpp 18 December 2002

REASONS FOR DECISION

[1] On 26 November 2002 applications were lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Hotels, Resorts, Hospitality and Motels Award, the Veterinary Services Award and the Leather, Canvas and Sheet Plastic Fabrication Award, respectively.

[2] When this matter came on for hearing Mr P Tullgren appeared for the union. Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI).

[3] These three applications were heard together.

[4] Mr Tullgren explained that the purpose of these applications was to increase the superannuation contribution to 9 per cent and thus achieve a level of consistency with the relevant Commonwealth legislation. In certain employment situations whereby monetary amounts are prescribed, such amounts are increased by 9 per cent.

[5] Ms Thomas advised that the application was not opposed. However the TCCI was consulting with their members in relation to possible exemptions from the nominated funds. It was acknowledged by both parties that, should it be necessary, the appropriate application/s would be lodged with the Commission.

[6] These applications are consistent with the Full Bench decision in T10410 of 2002.

[7] Accordingly, the applications are granted operative from the beginning of the first pay period to commence on or after 18 December 2002.
