REASONS FOR DECISION

[1] On 1 August 2003 an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Pasminco Hobart Smelter Award.

[2] When this matter came on for hearing, Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch, Mr P Baker appeared for the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union and Mr W FitzGerald, Australian Mines and Metals Association (Inc), appeared for Pasminco Hobart Smelter.

[3] Mr Flanagan explained that, with effect from 28 April 2003, the Award had been varied to incorporate State Wage decisions from earlier years.

[4] The purpose of this application was to reflect the most recent State Wage Case.1 It is the intention of the parties to include this award in the list of awards subject to future State Wage applications.

[5] As the employees of Pasminco Hobart Smelter are subject to a registered s.55 Agreement, the cost impact will be nil.

[6] Mr Baker supported the submissions of Mr Flanagan.

[7] Mr FitzGerald consented to the application.

[8] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[9] The application is granted operative from the beginning of the first full pay period to commence on or after 1 August 2003.

[10] An Order in the form of a consolidated award will be issued in due course.
