Award variation - Clause 29 - Part-Time Employees - penalty rates - consent matter - application granted - award varied - operative date ffpp 1 April 2004 and 1 January 2005 REASONS FOR DECISION [1] On 26 March 2004, an application was lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Hotels, Resorts, Hospitality and Motels Award. [2] The application sought to vary Clause 29 - PART-TIME EMPLOYEES. [3] A hearing was convened at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 1 April 2004 at 2.30 pm. [4] At the hearing Mr P Tullgren appeared for the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch. Mr P Mazengarb appeared on behalf of he Tasmanian Chamber of Commerce and Industry Limited. [5] Mr Tullgren and Mr Mazengarb presented oral submissions in support of the application. [6] Having considered those submissions, I am satisfied the variation does not offend s.36 of the Act or the Wage Fixing Principles and I approve the variation. [7] The Order giving effect to this Decision is attached.
