REASONS FOR DECISION

[1] On 2 April, an application was lodged by the Australian Liquor, Hospitality and Miscellaneous Workers Union - Tasmanian Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Hotels, Resorts, Hospitality and Motels Award, Restaurant Keepers Award and Licensed Clubs Award.

[2] The application sought to amend the awards in relation to penalty rates.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 22 April 2004. The parties wrote to the Commission requesting that this matter be dealt with ex parte.

[4] The awards will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The Orders giving effect to this Decision are attached.
