COMMISSIONER JP McALPINE

HOBART, 29 November 2004

Industrial Agreement - agreement approved - operative 1 November 2004 - to remain in force until 31 December 2005 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by St Vincent Industries (the employer) and the Health Services Union of Australia, Tasmania No. 1 Branch (the union), was for the purpose of filing an industrial agreement with the Commission.

[2] On 15 November 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Monday, 29 November 2004 at 9.30 am.

[3] The agreement, to be known as the St Vincent Industries Supported Employees Industrial Agreement 2004, is to be operative from the first full pay period on or after 1 November 2004 and it is to remain in force until 31 December 2005.

[4] Mr C Stringer for the union and the employer, presented a submission in support of the consent application.

[5] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
