REASONS FOR DECISION

[1] On 22 July 2003, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Butter and Cheesemakers Award.

[2] The application sought to vary the award from the from the first full pay period on or after 1 August 2004 to give effect to the fourth adjustment to wages in accordance with the minimum rates adjustment principle.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 6 August 2004 at 9.30 am.

[4] At the hearing Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. Mr N Gozzi and Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited. The parties agreed that a re-drafted schedule would be submitted to the Commission because "it appears that there is a need to amend the schedule to conform with the Commission's standards for formatting, in particular at the completion of the MRA process...the Commission formatting requires the incorporation...of a final supplementary payment with the base rate."1

[5] A re-drafted order was forwarded to the Commission on 26 August 2004. The order was incorporated in the consolidation of the award, Order No. 4 of 2004, with the July 2004 State Wage Case, T11548 of 2004.

[6] In view of the above the file is closed.
