Industrial agreement - application approved - operative date 2 November 2004 - 3 years REASONS FOR DECISION [1] On 4 October 2004, The Australian Workers' Union, Tasmania Branch and McIntosh "Fencing Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tas-Vic Interconnector Consortium BassLink Project Tasmania Enterprise Bargaining "Model" Agreement 2003-2006 (McIntosh Fencing). [2] When this matter came on for hearing on 2 November 2004, Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. By letter dated 2 November 2004, McIntosh Fencing Pty Ltd authorised Mr R Flanagan to also appear on their behalf. [3] Mr Flanagan explained that this agreement was to cover certain subcontract work associated with the Basslink Project and was a reflection of the "model" agreement applicable to the project as a whole. [4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [5] Pursuant to s.55(4) of the Act, the agreement is approved operative from 2 November 2004 and shall remain in force for a period of three years.
