TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Tasmanian Chamber of Commerce and Industry Limited NURSING HOMES AWARD
Award variation - meal charges - applications approved - operative date ffpp 14 January 2005 REASONS FOR DECISION [1] On 11 January 2005, applications were lodged by the Tasmanian Chamber of Commerce and Industry Limited (TCCI), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Nursing Homes Award and the Hospitals Award. [2] When these matters came on for hearing on 14 January 2005, Mr M Watson appeared for the TCCI. Mr T Jacobson, with Ms S Doherty, appeared for the Health Services Union of Australia, Tasmania No. 1 Branch. [3] These applications seek to increase meal charges in circumstances whereby an employee receives a meal provided by the employer. [4] Mr Watson explained that meal charges had remained unchanged since 1990 in the case of the Hospitals Award and 1992 in the case of the Nursing Homes Award. [5] The variations sought reflects changes in the CPI, ABS Catalogue 601. Table 7A, "meals out and take away food". [6] Both the HSUA and ANF consented to the application. [7] I am satisfied that the applications are consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [8] The applications are granted operative from the beginning of the first pay period to commence on or after 14 January 2005. [9] An order reflecting this decision is attached.
