REASONS FOR DECISION

[1] On 24 January 2005, an application was lodged by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU) pursuant to s.23 of the Industrial Relations Act 1984, to vary the Mobile Crane Hire Award.

[2] The application sought to vary expense related allowances to compensate employees for the rise in the cost of living over the period from June 2003-June 2004 to take into account movements in the Consumer Price Index.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 17 February 2005 at 9.30 am. At the hearing Mr T Benson appeared on behalf of the CFMEU. Mr P Mazengarb of the Tasmanian Chamber of Commerce and Industry Limited (TCCI) sent correspondence to the Commission advising that he would not be able to attend the hearing and that the TCCI did not oppose the application on the understanding that the award variation would be operative from the first full pay period on or after 17 February 2005.

[4] Mr Benson gave an oral submission in support of the application. Having considered this submission, I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The order reflecting this decision, with an operative date of 17 February 2005, is attached.
