REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Maritime Officers' Union Victoria Tasmanian Area and North Western Shipping & Towage Co. Pty Ltd, was for the purpose of filing an industrial agreement with the Commission.

[2] The parties to the agreement are The Australian Maritime Officers' Union Victoria Tasmanian Area and North Western Shipping & Towage Co. Pty Ltd.

[3] The agreement, to be known as the North Western Shipping & Towage Burnie Marine Services Enterprise Agreement 2004, is to be operative from 10 February 2005 and remain in force until 20 June 2007.

[4] The agreement applies to the employment arrangements for employees of North Western Shipping and Towage Company Pty Ltd engaged in the Company's marine operations in and around the Port of Burnie as of 20 April 2001.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
