REASONS FOR DECISION

[1] On 11 February 2005, an application was lodged by the Australian Municipal, Administrative, Clerical and Services Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Optical Industries Award.

[2] The application sought to vary the award to give effect to Principle 7 - State Minimum Wage of the Wage Fixing Principles of the Tasmanian Industrial Commission and to reformat the award, consistent with Principle 13.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 2 March 2005 at 9.30 am.

[4] At the hearing Mr R Flanagan of the Australian Workers' Union, Tasmania Branch, appeared on behalf of the Australian Municipal, Administrative, Clerical and Services Union. Ms J Thomas appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[5] Oral submissions were presented by Mr Flanagan and Ms Thomas.

[6] Having considered those submissions, I am satisfied the variation sought does not offend s.36 of the Act and is consistent with the Wage Fixing Principles and I approve the variation.

[7] The Order and [Correction Order] giving effect to this Decision is attached.
