REASONS FOR DECISION

[1] On 12 April 2005, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Horticulturists Award.

[2] The application sought to vary the award by inserting the Commission's standards in relation to the Minimum Wage and Ordinary Hours of Work.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 11 May 2005 at 10.30 am.

[4] At the hearing Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch.

[5] Mr Flanagan sought to delete the reference to Hours of Work from the application.

[6] Mr M Watson of the Tasmanian Chamber of Commerce and Industry Limited was unable to attend. He advised the Commission by facsimile that:

"...we consent to the variation of the award in relation to the new minimum wage clause. Further it has been agreed with the AWU that there will be further discussions in relation to the second part of the application regarding hours of work in the near future."

[7] The application was amended accordingly. Mr Flanagan made a submission in support of the application.

[8] Having considered this submission, I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[9] The order reflecting this decision, with an operative date of 12 May 2005, is attached.
