Industrial Agreement - agreement approved - operative 10 January 2005 until 10 January 2008 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (the union) and Montague Cold Storage (Tasmania) Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Magistrates Court, 19 King Edward Street, Ulverstone, Tasmania on Monday 23 May 2005 at 2.30 pm. At the hearing Mr S Littler appeared for the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union . Ms D Morgan appeared for Montague Cold Storage (Tasmania) Pty Ltd

[3] The agreement, to be known as the Montague Cold Storage (Tasmania) Pty Ltd Devonport Agreement 2005, is to be operative on and from 10 January 2005 and it is to remain until 10 January 2008.

[4] The agreement applies to all of the employer's employees who are employed at the employer's establishment at Montague Devonport and employed in classifications or occupations covered by the agreement in Clause 7 and/or are eligible for membership of the union, whether members of the union or not.

[5] Oral submissions were presented by Mr Littler.

[6] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
