REASONS FOR DECISION

[1] On 20 May 2005, an application was lodged by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc., pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award, the Community and Health Services (Public Sector) Award, the Sea Fisheries Award and the Police Departmental Employees Award.

[2] The application sought to vary expenses related allowances.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 8 June 2005 at 9.30 am.

[4] At the hearing Mr R Miller appeared for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr P Aiken appeared for Health Services Union of Australia, Tasmania No. 1 Branch and Mr P Baker appeared for the Minister administering the State Service Act 2000.

[5] Mr Miller, Mr Aiken and Mr Baker all gave oral submissions in support of the application.

[6] The award will be varied in the manner sought with an operative date of the first full pay period on or after 9 June 2005. The variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The Orders giving effect to this Decision are attached.
