REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (the LHMU), the National Union of Workers (Central Branch) (the NUW) and Cripps Nubake Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 6 June 2005, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Thursday 23 June 2005 at 10.00 am.

[3] The agreement, to be known as the Cripps Nubake Enterprise Agreement 2004, is to be operative from the first full pay period to commence on or after 1 November 2004 and it is to remain in force until 31 October 2006.

[4] The agreement applies to all employees of Cripps Nubake Pty Ltd who fall within the scope of the Wholesale Plant Bakeries Award and are employed at the following premises:

    11 Hobart Road, Kingsmeadows;
    11 Swallow Parade, Glenorchy; and
    9-11 Fielding Way, Ulverstone;

and at any other premises which the employer may open during the course of the agreement.

[5] Mr P Tullgren presented submissions for the LHMU and the NUW; Ms J Thomas, Tasmanian Chamber of Commerce and Industry Limited, with Mr P Gadomski, presented submissions on behalf of the employer.

[6] Having considered the submissions of the parties, I am satisfied the agreement should be approved as it satisfies s.36 of the Act.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
