COMMISSIONER JP McALPINE

HOBART, 23 June 2005

Industrial Agreement - agreement approved - operative 23 June 2005 - to remain in force for a period of 12 months - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA) and clubhouse Tasmania Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 6 June 2005, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Thursday 23 June 2005 at 9.30 am

[3] The agreement, to be known as the Clubhouse Tasmania Inc. (Salary Packaging and Salary Sacrifice) Agreement 2005, is to be operative on and from 23 June 2005 and is to remain in force for a period of 12 months.

[4] Mr C Stringer ,for the HSUA, presented a submission in support of the application. In correspondence dated 8 June 2005, Ms M Fay, on behalf of the employer, supported the consent application.

[5] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
