CORUMBENE NURSING HOME FOR THE AGED INC. (FLEXIBLE HOURS) INDUSTRIAL AGREEMENT 2005

REASONS FOR DECISION

[1] On 22 June 2005, the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) and Corumbene Nursing Home for the Aged Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Corumbene Nursing Home for the Aged Inc. (Flexible Hours) Industrial Agreement 2005.

[2] When this matter came on for hearing on 1 July 2005, Mr T Kleyn appeared for the HSUA. Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, and Mr A Power, appeared for Corumbene.

[3] Mr Kleyn explained that this agreement represented the outcome of extensive discussions over several months following earlier proceedings before the Commission in T11924 of 2005.

[4] The agreement provides for flexibility of hours and the details of the agreed outcome to the dispute are recorded in Schedule A of the agreement.

[5] Mr Watson supported the submissions of Mr Kleyn.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.(55)(4) of the Act, the agreement is approved operative from 1 July 2005 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
