Award variation - expense related allowances - transfer expenses - bereavement leave - defence service leave - approved - operative date ffpp 18/7/05 REASONS FOR DECISION [1] On 1 July 2005, an application was lodged by the Police Association of Tasmania, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Police Award. [2] When this matter came on for hearing on 18 July 2005, Ms A Bradford appeared for the PAT. Mr F Ogle and Mr J Beach appeared for the Commissioner of Police. [3] Ms Bradford explained that this application sought to adjust a range of allowances in accordance with a previously established formula, being the change in the CPI between the March quarter 2004 and the March quarter 2005. This resulted in an adjustment of 2.36%. [4] The application also sought to vary Clause 12 - Transfer Expenses. Allowances in this clause had previously been determined by Ministerial determination. The allowances had not been adjusted for a number of years and the application sought to restore purchasing power in light of contemporary market conditions. In the future it was intended to adjust allowances on an annual basis. [5] The Bereavement Leave clause is to be varied to facilitate re-crediting arrangements when bereavement leave coincided with another form of leave. [6] The Defence Service Leave clause is amended to clarify the position in relation to "working" days. [7] Mr Ogle supported the submissions of Ms Bradford. [8] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [9] The application is approved operative from the beginning of the first pay period to commence on or after 18 July 2005. [10] The order reflecting this decision is attached.
