ENTERPRISE AGREEMENT 2004-2007

REASONS FOR DECISION

[1] On 2 August 2005, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch and Munro Fencing Western Australia Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU and The Munro Fencing Western Australia Pty Ltd Enterprise Agreement 2004-2007.

[2] When this matter came on for hearing on 16 August 2005, Mr W White appeared for the CFMEU and provided a letter of authority to appear on behalf of Munro Fencing Western Australia Pty Ltd.

[3] This agreement covers all direct employees engaged on civil and building construction sites in Tasmania.

[4] Mr White explained that the agreement contained provision for an Enterprise Allowance which embraced most of the disability and special allowances contained in the award.

[5] The agreement also provided for flexibility in the taking of RDOs, and expanded radius for the payment of Fares and Travel Pattern Allowance, together with a Redundancy clause.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s55(4) the agreement is approved operative from the beginning of the first pay period to commence on or after 27 July 2005 and shall remain in force until 1 March 2008.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
