REASONS FOR DECISION

[1] On 11 August 2005 the Australian Municipal, Administrative, Clerical and Services Union and Community Connections Inc. lodged with the Registrar, pursuant to s.55(2) of the Industrial Relations Act 1984, the BYAS - ASU INDUSTRIAL AGREEMENT 2005.

[2] On 15 August 2005, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Tuesday, 23 August 2005 at 11.30 am.

[3] Mr I Paterson appeared on behalf of the Australian Municipal, Administrative, Clerical and Services Union. Ms A Millhouse with Mr M Watson appeared on behalf of Community Connections Inc.

[4] Mr Paterson explained that this agreement dealt with a number of matters that have been agreed between the parties in relation to the reclassification of shelter employees and changes to working hours as part of the restructure of operations subject to the agreement. Ms Millhouse concurred with the submission of Mr Paterson and informed the Commission the agreement was consistent with both the Wage Fixing Principles and the public interest requirements of the Act

[5] The agreement, to be known as the BYAS - ASU INDUSTRIAL AGREEMENT 2005, is to be operative from the first full pay period to commence on or after 1 October 2005 and shall operate for a period of 3 years.

[6] I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
