REASONS FOR DECISION

[1] On 23 August 2005, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch and Fall Protection Systems Tasmania lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU and Fall Protection Systems Tasmania Enterprise Agreement 2005-2007.

[2] When this matter came on for hearing on 9 September 2005, Mr A Benson appeared for the CFMEU and, with written authority, appeared for Fall Protection Systems Tasmania.

[3] Mr Benson outlined the key features of this agreement and advised that all employees had been fully consulted and endorsed the agreement.

[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[5] Pursuant to s.55[4] the agreement is approved operative from 23 August 2005 and shall remain in force until 15 November 2007.

[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
