Award variation - expense related allowances - meal allowance - applications approved - operative date 9 September 2005

REASONS FOR DECISION

[1] On 24 August 2005, applications were lodged by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Mobile Crane Hire Award, the Building and Construction Industry Award and the Building Trades Award.

[2] When these matters came on for hearing on 9 September 2005, Mr A Benson appeared for the CFMEU. Mrs S Haas appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI).

[3] These applications seek to increase expense related allowances to reflect changes in the relevant CPI index between 1 July 2004 and 30 June 2005.

[4] In the case of the meal allowance, the applications seek to incorporate movements in the CPI for the two previous financial years, which Mr Benson said had been inadvertently overlooked.

[5] Details of the calculation methodology are contained in the files.

[6] Mrs Haas indicated that the TCCI consented to the applications.

[7] I am satisfied that the applications are consistent with both the Wage Fixing Principles and the public interest requirements of the Act. The applications are approved operative from 9 September 2005.

[8] Orders reflecting this decision will follow.
