REASONS FOR DECISION

[1] On 14 September 2005, The Australian Workers' Union, Tasmania Branch and R A & C P Storey Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the R A & C P Storey Pty Ltd Silviculture and Afforestation Industrial Agreement 2005.

[2] When this matter came on for hearing on 23 September 2005, Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch and a letter of authority was received by the Commission for Mr Flanagan to appear on behalf of R A & C P Storey Pty Ltd.

[3] Mr Flanagan said that this agreement replaces an earlier agreement (T11704 of 2004) and was consistent with a number of agreements in place or currently being negotiated across the Silviculture and Afforestation industry.

[4] The agreement has been amended to reflect the most recent State Wage Case decision.

[5] Employees affected have been consulted and endorse the agreement.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55(4) of the Act, the agreement is approved operative from 1 August 2005 and shall remain in force until 1 August 2006.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
