REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and D W How Forest Contracting Services (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 10 October 2005, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Tuesday 18 October 2005 at 9.00 am.

[3] The agreement, to be known as the D W How Forest Contracting Services Silviculture and Afforestation Industrial Agreement 2005, is to be operative on and from 1 August 2005 and it is to remain in force until 1 August 2006.

[4] The agreement applies to all employees of the employer for whom a classification appears in this agreement.

[5] Mr R Flanagan appeared for the union and for the employer.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
