REASONS FOR DECISION

[1] This is an application pursuant to s 23 of the Industrial Relations Act 1984 (the Act) by The Australian Workers' Union, Tasmania Branch (AWU) to make an award to be known as the TOTE Tasmania Racecourse Award 2005 (the award).

[2] The award defines the work to be performed as follows:

    This Award shall apply in respect to the employment of employees engaged in work in, or in connection with the formation and maintenance of racecourse tracks in the State of Tasmania, including but not limited to Elwick Racecourse, Mowbray Racecourse, Longford Racecourse and Brighton Training Centre.

[3] The following employee organisation has an interest in the award pursuant to s.63(10) of the Act.

    The Australian Workers' Union, Tasmanian Branch

[4] The following employer organisation has an interest in the award pursuant to s.62(2) of the Act.

    Tasmanian Chamber of Commerce and Industry Limited

[5] The following organisation has an interest in the award pursuant to s62(3) of the Act.

    The Tasmanian Trades and Labor Council.

[6] The award has been negotiated by the parties and is presented to the Commission by consent.

[7] I have perused the provisions found in the award and am satisfied that it is in accord with the Wage Fixing Principles and the public interest requirements of the Act.
