REASONS FOR DECISION

On 26 October 2005, an application was lodged by the Australian Workers' Union, Tasmania Branch (AWU), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Dairy Processing Award.

A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 1 December 2005 at 9.30 am.

At the hearing Mr M Watson of the Tasmanian Chamber of Commerce and Industry Limited (TCCI) appeared both for the TCCI and for the AWU. He presented an oral submission.

I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

The order reflecting this decision, with an operative date of 1 August 2004, is attached.
