REASONS FOR DECISION

[1] On 27 October 2005, The Australian Workers' Union, Tasmania Branch and T J Hughes lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Australian Workers' Union - T J Hughes - Shearing Industry (Tasmania) Enterprise Bargaining Agreement 2005-2006.

[2] When this matter came on for hearing on 3 November 2005, Mr R Flanagan appeared for the AWU and, with written authority, appeared for T J Hughes.

[3] Mr Flanagan explained that the agreement reflected the existing terms of the Pastoral Industry Award 1998, including the 2005 National Wage Case. The purpose of the agreement was to bring a degree of certainty to industrial regulation in the current political environment. There was no cost impact in that the agreement reflected rates and conditions actually being paid.

[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[5] Pursuant to s.55(4) of the Act, the agreement is approved operative from 31 October 2005 and shall remain in force for a period of 12 months.

[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
