REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by Anglicare Tasmania Inc. (the employer) and the Health Services Union of Australia, Tasmania No. 1 Branch (the union), was for the purpose of filing an industrial agreement with the Commission.

[2] On 1 December 2005, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Friday 16 December 2005 at 9.30 am.

[3] The agreement, to be known as the Anglicare Tasmania Inc. (Personal Support Workers) Industrial Agreement 2005, is to be operative on and from the 16 December 2005 and it is to remain in force for a period of two years.

[4] Mr T Kleyn, appeared for the union and Ms S Gibson, for the employer.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
