WILLIAMS ELECTRICAL PTY LTD CONTRACTING ENTERPRISE AGREEMENT

Industrial Agreement - agreement approved - operative 19/12/06 - to remain in force until such time as the parties reach agreement of a replacement enterprise agreement - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the union) and William Electrical Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Tuesday 27 February 2007 at 3.30 pm.

[3] The agreement, to be known as the Williams Electrical Pty Ltd Contracting Enterprise Agreement, is to be operative on and from 19 December 2006 and it is to remain in force until such time as the parties reach agreement on a replacement enterprise agreement.

[4] The agreement applies to all employees of the employer employed under classifications contained in the National Electrical, Electronic and Communications Contracting Industry Award 1998 and shall only apply to the employer's operations and work carried out in the State of Tasmania.

[5] Mr K Harkins appeared for the union and also represented the employer.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
