REASONS FOR DECISION

[1] On 8 March 2007, the Minister administering the State Service Act 2000, the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch and Ms Anne Reid, lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Rosny College Canteen Supervisor Industrial Agreement 2006.

[2] When this matter came on for hearing on 19 March 2007, Ms K Gunn, with Mr M Watson, appeared for the Minister. Mr P Tullgren appeared for the Union.

[3] Mr Tullgren explained that as a consequence of a transfer in employment from the Rosny College Council to the Department of Education it was appropriate that the terms and conditions of employment for the Canteen Supervisor be recorded in a registered industrial agreement. Mr Tullgren said the agreement effectively preserved the status quo insofar as employment conditions are concerned.

[4] Ms Gunn supported the submissions of Mr Tullgren.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employee concerned.

[6] Pursuant to s.55(4) of the Act, the agreement is approved operative from 16 November 2006 and shall remain in force for the duration of Ms Reid's tenure, or for a period of three years, whichever is the lesser.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
