THE MACQUARIE ISLAND CONDITIONS OF SERVICE AGREEMENT 2007

Industrial Agreement - agreement approved - operative 15 August 2007 for a period of three years - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and the Minister administering the State Service Act 2000 (Department of Premier and Cabinet) (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the 4th Floor, Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Wednesday 15 August 2007 at 9.30 am.

[3] The agreement, to be known as The Macquarie Island Conditions of Service Agreement 2007, is to be operative on and from 15 August 2007 and it is to remain in force for a period of 3 years.

[4] The agreement applies to all State Service employees of the Department of Tourism, Arts and the Environment (DTAE) and of the Department of Primary Industries and Water (DPIW) who are expeditioners or visitors to Macquarie Island.

[5] Mr M Di Pretoro appeared for the union and Ms J Fitton appeared for the employer.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
