Rescission of award – award rescinded - operative 18 April 2008

 REASONS FOR DECISION

[1] This application, made by Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the applicant), sought to rescind the Meander Dam Development Project Enterprise Award.

[2] The matter was set down for hearing on Friday, 18 April 2008 at 10.30 am in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[3] The following organisations were advised of the hearing details:

· Construction, Forestry, Mining and Energy Union, Tasmanian Branch

· The Australian Workers' Union, Tasmania Branch

· Civil Contractors Federation – Tasmanian Branch

· Tasmanian Chamber of Commerce and Industry Limited

· Tasmanian Trades and Labor Council

· Minister for Infrastructure, Resources, Planning and Workplace Relations.

[4] Mr B White, for the applicant, presented a submission to the Commission which, simply stated, confirmed that the award had been established to cover all on-site civil construction work associated with the construction of the Meander Dam. He advised that the project has now been completed, therefore the award no longer serves a purpose and should be rescinded.

[5] Given the submissions of the parties to the award, I hereby determine that the Meander Dam Development Project Enterprise Award be rescinded as an award of the Tasmanian Industrial Commission on and from the 18 April 2008, and I so Order.

[6] The Order giving effect to this decision is attached.
