 REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) and the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU), (the unions), and the Minister administering the State Service Act 2000 (MASSA), (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, Hobart on Thursday 30 October 2008.

[3] The agreement, to be known as the Department of Health and Human Services Rostered Carers Agreement 2008, is to be operative from the first full pay period on or after 30 October 2008 and it is to remain in force for a period of twelve months.

[4] The agreement applies to all staff employed under the provisions of the Community and Health Services (Public Sector) Award who are undertaking Rostered Carers duties in Children and Family Services.

[5] Ms K Webb appeared for the HSU1 with Mr T Jacobson and Ms C Serra for the CPSU. Mr R Clegg of the Department of Health and Human Services (DHHS) appeared for MASSA with Mr M Bennett.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
