Rescission of award – award rescinded - operative 31 March 2009


REASONS FOR DECISION

[1] This application, made by the Minister Administering the State Service Act 2000 (the Minister), sought to rescind the Fire Service Award.  The matter was set down for hearing on Tuesday, 31 March 2009 at 9.00 am in the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania.

[2] The following organisations were advised of the hearing details:

  • The Public Officer, The Community and Public Sector Union (State Public Services Federation Tasmania) Inc;
  • United Firefighters Union of Tasmania;
  • Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union;
  • Tasmanian Trades and Labor Council;
  • The Minister Administering the State Service Act 2000; and the
  • Minister for Workplace Relations.

[3] Mr P Baker, for the Minister, and Ms K Jackson for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc., presented submissions to the Commission which, simply stated, confirmed that the award had been superseded by the new Tasmanian State Service Award , therefore the award no longer serves a purpose and should be rescinded.

[4] Given the submissions of the parties to the award, I hereby determine that the Fire Service Award be rescinded as an award of the Tasmanian Industrial Commission on and from 31 March 2009, and I so Order.

[5] The Order giving effect to this decision is attached.
