REASONS FOR DECISION


[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (the union) and the Speaker of the House of Assembly (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Tuesday 17 March 2009.

[3] The agreement, to be known as the House of Assembly Staff Industrial Agreement 2009, is to be operative from the first full pay period on or after 5 March 2009 and it is to remain in force until 31 December 2011

[4] The agreement applies to all relevant persons employed under the provisions of the Parliamentary Privilege Act 1898 in the House of Assembly.

[5] Mr M Di Pretoro appeared for the union and Mr P Bennison for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
