REASONS FOR DECISION
[1] This is an application pursuant to s 23 of the Industrial Relations Act 1984 by the Minister Administering the State Service Act 2000 to vary the Legal Practitioners and Apprentice-at-Law Award (the award) in accordance with the award review process.
[2] When this matter came on for hearing on 25 June 2009, Mr P Baker appeared for the Minister; Mr M Johnston and Ms L Saunders appeared for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc.
[3] Having heard the submissions of the parties, I am satisfied that the award should be varied as outlined in the consent draft Order as presented by the parties at the hearing.
[4] In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act.
[5] The consolidation of the award reflecting the variations is attached and will take effect from 25 June 2009.
