REASONS FOR DECISION


[1] This application, lodged pursuant to s.59 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch was for the purpose of filing a variation to an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, Hobart, Tasmania, on Thursday 18 February 2010 at 9.30 am.

[3] The variations to the Teaching Service (Tasmanian Public Sector) Salary and Conditions of Employment Agreement 2008 are to be operative from the first full pay period on or after 1 March 2010.

[4] Mr C Lane, for the Australian Education Union, Tasmanian Branch, and Ms D Crespan, for the Minister administering the State Service Act 2000, presented submissions in support of the consent application.

[5] The parties advised that the application sought to vary the agreement by the inclusion of a new Schedule 3 - Salaries and by amending subclauses 2.1.1 to 2.1.5 of Schedule 1 - Incentive Payments for Employees in Designated Schools

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] An Order giving effect to the variation is attached.
