AMBULANCE TASMANIA AGREEMENT 2010

REASONS FOR DECISION


[1] On 30 March 2010, the Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984 (the Act), the Ambulance Tasmania Agreement 2010.

[2] When this matter came on for hearing on 8 April 2010, Mr R Clegg appeared for the Minister, and Mr C Brown appeared for the HSU1 with Ms M Jamieson.

[3] Mr Clegg submitted that the agreement was a consequence of extensive negotiations over many months.  The key feature of the agreement is the new career structure which reflects changes in training and the introduction of tertiary qualifications for paramedics.

[4] Mr Brown endorsed the agreement, noting that clause 10, No Extra Claims, does not preclude a future work value claim being pursued under clause 13, Work Value Claims.  Mr Clegg confirmed this understanding.

[5] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[6] Pursuant to s55(4) of the Act, the agreement is approved operative from 8 April 2010 and shall remain in force until 30 November 2012.  The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
