Variation of industrial Agreement - salaries - variation approved – operative ffpp on or after 17/2/11

REASONS FOR DECISION

[1] This application, lodged pursuant to s.59 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch was for the purpose of filing a variation to an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, Hobart, Tasmania, on Thursday 3 March 2011 at 9.30 am.

[3] The variations to the Teaching Service (Tasmanian Public Sector) Salary and Conditions of Employment Agreement 2008 are to be operative from the first full pay period on or after 17 February 2011.

[4] Mr C Lane, for the Australian Education Union, Tasmanian Branch, and Ms D Crespan, for the Minister administering the State Service Act 2000, presented submissions in support of the consent application.

[5] The parties advised that the application sought to vary the agreement by the inclusion of a new Schedule 3 - Salaries and by amending subclauses 2.1.1 to 2.1.5 of Schedule 1 - Incentive Payments for Employees in Designated Schools

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] An Order giving effect to the variation is attached.
