TASMANIAN FIRE SERVICE (TASFIRE EQUIPMENT) INDUSTRIAL AGREEMENT 2010

REASONS FOR DECISION

[1] On 26 May 2011, the Minister administering the State Service Act 2000 and the United Firefighters Union of Australia Tasmania Branch (UFUA Tas Branch) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984 (the Act), the Tasmanian Fire Service (TasFire Equipment) Industrial Agreement 2010

[2] When this matter came on for hearing on 27 May 2011, Ms R Pearce appeared for the Minister, and Mr P Tullgren appeared for the UFUA Tas Branch.

[3] Ms Pearce submitted that the 2010 agreement encompasses rates and conditions for Fire Equipment Officers that were previously covered by the Tasmanian Firefighters Industry Employees Award.  The agreement aligns position classifications where practicable, with State Service Award classifications.

[4] Mr Tullgren endorsed the agreement.

[5] The agreement, to be known as the Tasmanian Fire Service (TasFire Equipment) Industrial Agreement 2010, is to be operative on and from 1 July 2010 and to remain in force until 30 June 2013.

[6] The agreement applies to all employees classified as Fire Equipment Officers covered by the Tasmanian Fire Fighting Industry Employees Award.

[7] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[8] Pursuant to s55(4) of the Act, the agreement is approved operative from 1 July 2010.  The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
