REASONS FOR DECISION

APPEARANCES:

For the Registrar,
Tasmanian Industrial Commission
- Mr. Q. H. James
  with
  Mr. P. J. Russell

For the Federated Rubber and Allied Workers' Union,
Victorian Branch
- Mr. D. Strickland

DATE AND PLACE OF HEARING:

14.12.88                     Hobart

Consequent on a written request made to him in that regard, the Registrar, pursuant to Section 68(1) (a) (ii) of the Industrial Relations Act 1984, sought cancellation of the registration of the Federated Rubber and Allied Workers' Union of Australia, Victorian Branch (the Rubber Workers).

The application was made following certain organisational changes affecting both the Federally registered Rubber Workers and the Federated Storemen and Packers' Union of Australia (Storemen and Packers). Those changes impacted upon the State registered branches of the two bodies referred to.

During proceedings the Registrar requested the Bench to consider the question of "Parties and Persons Bound" provisions in those awards in which the Storemen and Packers and the Rubber Workers are currently cited.

Subject to determination of interest proceedings, we are of the view that the affected awards, as set out hereunder, should be varied on the motion of the Commission as provided for by Section 24(3) of the Act in order to maintain the status quo.

We anticipate therefore that Commissioners who have assigned to them the following awards will initiate proceedings to give effect to the foregoing.

The Registrar, by notice dated 14 December 1988, indicated that he had approved of the requested name change of the Storemen and Packers to that of the new organisation.

Awards affected by our decision on this application are:

Rubber Trades Award Marine Boards Award
Automotive Industries Award Mechanical Engineers and Founders Award
Chemists Award Produce Award
Fuel Merchants Award Retail Trades Award
Softgoods Award Wholesale Trades Award
