Award variation - to flow on to all private sector awards a minimum adult entry level classification rate of $359.40 as contained in the decision of the Australian Industrial Relations Commission of April 1997 (Print P1997) - application withdrawn - matter concluded

REASONS FOR DECISION

This application was lodged by the Tasmanian Trades and Labor Council. The application originally was to vary all private and public sector awards of Commission to flow on to those awards the minimum wage component contained in the decision of the Australian Industrial Relations Commission of April 1997 (Print P1997).

The matter came before the Full Bench for hearing on 28 August 1997. At that time Ms Fitzgerald, for the Tasmanian Trades and Labor Council, submitted that the intention of the Council was to flow on that component of the AIRC decision which dealt with the establishment of $359.40 as a minimum adult entry level classification rate in all private sector awards. The application was amended to reflect more accurately that intention. The parties then requested an adjournment of the hearing to enable further negotiations to occur.

When the hearing resumed on 5 November 1997 the parties reported that there was the prospect of a consent position to the application, and they again requested that the hearing be adjourned to allow discussions to continue

On resumption on 2 December 1997, Ms Fitzgerald informed the Commission that the parties had been unable to agree on an outstanding matter. She said the employers had been advised that "despite resolution or otherwise of that matter" the organisation would seek leave of the Commission to withdraw the application. Ms Fitzgerald made that request.

No organisation expressed opposition to the TTLC submission and, having regard to the circumstances, the application to withdraw the matter is granted and the file is closed.
