T1778 - Robinson - 13 March

IN THE TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984

T.1778 of 1988

IN THE MATTER OF PROCEEDINGS INSTITUTED IN ACCORDANCE WITH SECTION 24(3) OF THE INDUSTRIAL RELATIONS ACT TO VARY THE CHEMISTS AWARD AND THE MARINE BOARDS AWARD

RE: PARTIES AND PERSONS BOUND

DEPUTY PRESIDENT

HOBART, 13 March 1989

REASONS FOR DECISION

APPEARANCES:

For the National Union of Storeworkers, Packers, Rubber and Allied Workers, Tasmanian Branch

- Mr D. Strickland

DATE AND PLACE OF HEARING:

13 March 1989  Hobart

This is a consequential matter following the name change of the Federated Storemen and Packers Union of Australia, Tasmanian Branch to that of the National Union of Storeworkers, Packers, Rubber and Allied Workers, Tasmanian Branch.

The history, details and reasons for the name change are described in the decision of a Full Bench of this Commission dated 21 December 19881.

In that decision the Full Bench said at page 2 that it anticipated that Commissioners who have awards assigned to them which make reference to the now defunct Federated Rubber and Allied Workers' Union of Australia, Victorian Branch or the Federated Storemen and Packers Union of Australia, Tasmanian Branch, would initiate proceedings to give effect to the alterations approved by it.

As a consequence the Chemists Award and the Marine Boards Award were made the subject of a hearing to deal with proposed alterations concerned.

In the light of no objections being raised to giving effect to the Full Bench decision I propose deleting from the 'Parties and Persons Bound' Clauses of the Chemists and Marine Boards Awards the name Federated Storemen and Packers Union of Australia, 2. Tasmanian Branch and inserting the name National Union of Storeworkers, Packers, Rubber and Allied Workers, Tasmanian Branch.

DATE OF EFFECT

The variation will come into effect on and from 13 March 1989.

Orders are attached.

A. Robinson
DEPUTY PRESIDENT
