Award variation - union amalgamation - delete all reference to ETU (Tasmanian Branch) and P&GEU (Tasmanian Branch) - insert Electrical Electronic Plumbing & Allied Workers Union - consent matter - award varied - operative 12 November 1993

REASONS FOR DECISION

These applications were lodged by the Electrical, Electronic, Plumbing and Allied Workers Union (EEPAWU) for the purpose of varying the abovementioned awards by deleting all reference to the Electrical Trades Union of Australia (Tasmanian Branch) (ETU) and the Plumbing and Gasfitters Employees Union (Tasmanian Branch) (P&GEU) and insert in lieu thereof the name of the Electrical, Electronic, Plumbing and Allied Workers Union of Australia.

Mr Randall for the EEPAWU tendered an exhibit (R2) being a decision of the Registrar of the Commission (TR.454 of 1993) which, amongst other things, cancelled the registration of the ETU and the P&GEU and stated -

"...a certificate of registration in the name of the Electrical, Electronic, Plumbing and Allied Workers Union of Australia will be issued bearing the names of those awards in which both of the deregistered organisations formerly held an interest."

In view of the fact that the Registrar has issued a certificate of registration in the name of the applicant in these matters, then it should follow that the awards be varied by deleting the names of the Electrical Trades Union of Australia (Tasmanian Branch) and the Plumbers and Gasfitters Employees Union (Tasmanian Branch) and inserting in lieu thereof the name of the new amalgamated organisation and I decide accordingly.

The Orders arising out of this decision will be drawn by the members of the Commission, who have within their assignment, the respective awards that were the subject of this hearing.

The Orders giving effect to this decision will be operative from 12 November 1993.
